Under section 66 of the Labour Relations Act 1996 (click
here), a sitting of the Industrial Relations Court on points of both
law and fact is constituted by the Chairperson or Deputy Chairperson
and a member panelist from the most represented employees union and a
member panelist from the most represented employers union.
Further the Chairperson or Deputy Chairperson or
Registrar of the Industrial Relations Court do have jurisdiction to
mediate over labour and employment disputes at prehearing conferences as
stipulated under Rule 13 of the Industrial Relations Court Rules 1999(click
here)
Matters at the Industrial Relations Court are heard
primarily at the Principal Registry, Blantyre and Lilongwe Registry,
Lilongwe. The Industrial Relatiosn Court does go on circuit in high
employment prevalent districts such as Chikwawa, Mulanje, Zomba, and
Thyolo in the Southern Region and Dowa, Salima, Kasungu, Nkhotakota,
Mchinji in the Central Region and Mzuzu, Karonga, Rumphi in the Northern
Region.
