Institutional Framework
The
Industrial Relations Court (IRC) publications have been drawn within the
IRC Series which brings together collected materials on labour law.
Labour Law has changed form in Malawi since the introduction of right to
fair labour practice in the Malawi Constitution. While previously labour
law was predominantly governed by principles of common law, the advent
of the Constitution introduced a new concept that recognizes an
individuals right to fair labour practice. In fulfillment of this right,
the Constitution created the Industrial Relations Court to hear and
determine labour disputes. In its operations the IRC observed that many
stakeholders are yet to grasp the concept of this right and the
requirements for its enforcement, promotion and protection. The IRC
Series therefore was initiated by the IRC with financial support from
the Danish Institute for Human Rights to promote awareness in this field
through among others, outreach programmes and publications.
